Fraudulent behaviour and breach of contract by Debitsuccess and Configure Express Albany
I have been a member of Configure Express Albany since August 2012.
On, 8th December 2014, I called Configure Express Albany to cancel my membership, and I got referred to call Debitsuccess (0800 481 0400), saying that debit success will stop my payments for me.
I wanted to cancel my gym membership as it was closed on some days and finished early for around 10 days. I found a different gym that was open 24hrs.
I Called debit success on the same day (8th of December) at around 1:10 pm. They said that I had to give 30 days’ notice, and that the last payment will be on the 7th of January (Wednesday).
I had a look at the calendar and counted the 30 days - the last day came out to be the 6th of January (Tuesday). I felt this was unfair as I had to pay an extra week’s worth, as I would be paying for a total of 37 days at the gym.
Also, my contract did not expressly state that there was a 30 day notice period. Nor did I ever sign any document that expressly stated a 30 days’ notice. In fact, my contract states that I could terminate whenever I wanted to
I did not feel obliged to give them the 30 days’ notice. So I called debit success back the next day at 9:52am. Firstly, I asked them how they came up with the 7th of January when in fact it should be the 6th of January. The person I talked to said that it was computer generated and there was nothing she could do.
Also, I told her that my contract does not say anything about a 30 days’ notice, and that I never signed or agreed to it.
She said that a welcome letter always gets sent out and on it there is something about the 30 days’ notice. I do not remember receiving such mail, and told her this. She said that she could forward it. I emphasized that my contract did not have that on it, and suggested to her that I send it. She said yes, then she stated out that they sent me a letter. She sounded rude, and I felt bullied.
Apparently they record all calls for professional development.
My contract does not state anything about a 30 days’ notice, and Debitsuccess has no right to charge me an extra week. It seems fraudulent to act outside of contract and is therefore illegal conduct. I really hope this is solved and that other people do not get robbed by this fraudulent company.
